Privacy Policy

1. Introduction

We, Leapwork Technologies Private Limited (“LeapOnboard” or “we” or “us” or “our”), are committed to protecting user privacy and data per applicable law. This privacy policy (“Privacy Policy”) sets out the types of information that we may collect from you when you access or use our Platform; and our practices for collecting, using, maintaining, protecting, handling, transferring and disclosing such information.

For the purposes of this Privacy Policy, capitalised terms which are used here, shall unless defined otherwise, have the same meaning as ascribed under the Terms of Service. This Privacy Policy is a part of the Terms of Service and must be read together with it. It does not constitute a standalone document.

By accessing or using our Platform, you acknowledge and consent to this Privacy Policy.

2. Scope

LeapOnboard provides a platform for its clients, i.e., potential employers / future employers / recruiters (“Clients”) to engage with potential candidates and/or future employees and/or current employees (“Individuals” or “you”). This Privacy Policy applies to Individuals as well as any individuals who visit or access the Platform with or without registering for an account, or who provide any personal data to us through other means, such as filling out a contact form or subscribing to any newsletter (“Visitor”).

This Privacy Policy applies to all data that is created, collected, maintained, utilized or stored during the use of our Platform including personal data, personal information and/or sensitive personal data. However, notwithstanding anything to the contrary, this Policy does not apply to anonymised, de-identified or aggregate information or data which falls outside the purview of the protected user data per applicable law.

This Privacy Policy also does not apply to any third-party applications or software that can be accessed from the Platform, such as external applicant tracking systems, social media websites or partner websites (“Third Party Services”). At times, you may be able to access other Third-Party Services/websites through the Platform, for example by clicking on links to those Third-Party Services from within the Platform. We are not responsible for the privacy policies and/or practices of these Third-Party Services, and you are responsible for reading and understanding those Third-Party Services’ privacy policies.

3. LeapOnboard as a Service Provider / Data Processor

Our Clients are our customers who use the Platform to interact and engage with Individuals. As a service provider to our Clients, we act strictly as a data processor processing personal data solely in accordance with our Client’s instructions. Any information that is provided by you, uploaded by you on our Platform and/or requested by our Clients, will be governed solely by the Client’s privacy practices. The Client has control over any such personal data. We encourage you to reach out to the Clients on the details of their privacy practice.

The Client is also responsible for inter alia defining the data retention period for such data, taking into consideration the purpose for which the data was collected and processed, the applicable legal requirements, and the Client’s own data retention policies. For any personal data which you have provided to the Client, whether through the Platform or otherwise, and you wish to exercise any rights you may have under applicable data protection laws and/or have any questions in relation to such rights, please inquire with the relevant Client directly.

LeapOnboard only processes such personal data in accordance with the instructions of the Client. LeapOnboard does not undertake any liability or responsibility, except to the extent required under applicable law, for any data or information, including personal data / personal information and/or sensitive personal data or information, with respect to which LeapOnboard is only the data processor.

4. Personal Data collected by LeapOnboard as Data Fiduciary

We may collect the Personal Information of Users to provide better services and offerings.

For the purposes of this Privacy Policy, “Personal Information” means the information that can be associated with a specific person and could be used to identify that specific person. Anonymous or aggregated such that it can no longer be used to identify a specific person, shall not be considered to be Personal Information. Further, any information in relation to which we are the data processor (and not data fiduciary or data controller) shall also not be considered to be Personal Information.

Personal Details: The Personal Information which we collect, and how we collect it, will depend on the nature of your interaction with us and/or our Platform. We may collect Personal Information during the use of our Platform including:
• Full name
• Email address
• Contact details
• Company name
• Job level
• Job industry
• Job title
• Date of birth
• Address
In order to access some offerings on the Platform, you will need to have account authentication credentials, as part of which you may choose to provide us with additional details such as:
• Social media profiles
• Areas of expertise

Activity and Usage Information: We collect information related to how you use the Platform, including actions you take in your account (like your engagement and/or interactions with the Client, content you create on the Platform, how often you use the Platform, the events that occur within the Platform, aggregated usage, performance data, and where the application was downloaded, and so on). We use this information to provide, improve, and promote our Platform, and protect our users.

Device information: We also collect information from and about the devices you use to access the Platform. This includes things like IP addresses, the type of browser and device you use, the web page you visited before coming to our sites, and identifiers associated with your devices. Your devices (depending on their settings) may also transmit location information to the Platform. For instance, we use device information to detect abuse and identify and troubleshoot bugs.

Cookies and other technologies: We use technologies like cookies to provide, improve, protect, and promote our Platform. For example, cookies help us with things like remembering your username for your next visit, understanding how you are interacting with our Platform, and improving them based on that information. You can set your browser to not accept cookies, but this may limit your ability to use the Platform. We may also use third-party service providers that set cookies and similar technologies to promote our Platform.

Social Media Information: If you choose to sign in with your social media account(s) to access the Platform, or otherwise connect your social media account(s) with the services of the Platform, you consent to our collection, storage, and use of the information that you make available to us through the social media interface in accordance with this Privacy Policy. Please see your social media provider’s privacy policy and help centre for more information about how they share information when you choose to connect your account.

Camera and storage access: When using the Platform, we may request access to your device’s camera and storage. This allows you to take and upload pictures and/or documents and such access would only be used in ways you choose. You may at any time revoke access at the device level. We do not access your device’s camera and photo storage without your permission.

Bases for collecting your data: We collect and use the personal data described above in an attempt to provide you with access to and use of our Platform in a reliable and secure manner. We also collect and use personal data for our legitimate business needs and for the purposes set out in this Privacy Policy. To the extent we process your Personal Information for other purposes, we ask for your consent in advance. You can withdraw your consent at any time but it will not affect the lawfulness of the processing before your consent is withdrawn. If you would like to withdraw your consent, you can do so by contacting us per Section 11 of this policy below.

5. Children’s Personal Information

Our Platform is not intended for or directed to children under the age of eighteen. The Company does not knowingly collect personal information directly from children under the age of eighteen without parental consent. If we are made aware that a child under the age of eighteen has provided their personal information, LeapOnboard will delete the information from its records.

If the personal data of a child is received as a result of their parent being an employee of our Client, the privacy policy of the Client will apply. Any queries about the same should be directed to the Client.

6. How LeapOnboard uses your Personal Information

LeapOnboard uses the Personal Information collected to contact Individuals / Visitors and provide access to our Platform and to provide the required support. For example, if you provide data through a “Contact Us” form, your data will be used to respond to the request.

LeapOnboard uses your Personal Information about your activity on our Platform to contact you for marketing purposes in accordance with your marketing preferences, including telemarketing calls, and to send marketing emails that we believe may be of interest to you, such as product announcements, newsletters, educational materials, and details on upcoming events. The data is also used to send administrative information, such as notices related to products, services, or policy changes. A detailed account of how LeapOnboard uses your personal data is provided below:

To Plan and Manage Events: LeapOnboard uses your data for event planning and management, including registration, billing, and connecting with other event attendees or to contact you further about relevant products and services.

For Improvement Purposes: LeapOnboard uses the data collected to understand how the Platform is being used and to make improvements. For example, the company may solicit your feedback about your experience using our Platform, and ways to improve the Platform.

For Security and Investigations: LeapOnboard may use your information to diagnose website technical problems, as well as to prevent, detect, mitigate, and investigate potential security issues, as well as fraudulent or illegal activity.

To Personalize Your Experience: LeapOnboard also may use your data to personalize your experience on our websites. LeapOnboard or our service providers use website tracking technologies to display products, features, or content that are tailored to your interests and to present advertising on other sites.

For Market Research: LeapOnboard may use your data for market research purposes. This is done via functionality reporting on the data collected from you.

7. Analytics and tailored advertising

To help us better understand your use of our Platform, we may use third-party web analytics on our Platform, such as Google Analytics. The information collected by this technology will be disclosed to or collected directly by these service providers, who use the information to evaluate our users’ use of the Platform.

Third parties whose products or services are accessible or advertised via the Platform may also use cookies or similar technologies to collect information about your use of the Platform. This is done in order to help them: (i) inform, optimize, and serve ads based on past visits to our website and other sites; and (ii) report how our ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to our website.

We may also allow other third parties (e.g., ad networks and ad servers) to serve tailored ads to you on the Platform, and to access their own cookies or similar technologies on your computer, mobile phone, or other device you use to access the Platform.

We neither have access to nor do we govern, through this Privacy Policy or otherwise, the use of cookies or other tracking technologies that may be placed by such third parties.

These parties may permit you to opt out of ad targeting. Please note that to the extent advertising technology is integrated into the Platform, you may still receive ads even if you opt out of tailored advertising. In that case, the ads will just not be tailored to your interests. Also, we do not control any of the above opt-out links and are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms.

When accessing the Platform from a mobile application you may also receive tailored in-application advertisements. Each operating system: iOS, Android and Windows Phone provides its own instructions on how to prevent the delivery of tailored in-application advertisements. You may review the support materials and/or the privacy settings for the respective operating systems in order to opt out of tailored in-application advertisements. For any other devices and/or operating systems, please visit the privacy settings for the applicable device or operating system or contact the applicable platform operator.

8. Sharing of your information

Information Shared with our Service Providers: We may share your Personal Information with third parties who provide services to us. These third parties are authorized to use your Personal Information only as necessary to provide these services to us. These services may include the provision of (i) email services to send marketing communications, (ii) mapping services, (iii) customer service or support, and (iv) providing cloud computing infrastructure.

Information Disclosed Pursuant to Business Transfers: In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur and that any acquirer of us or our assets may continue to use your Personal Information as set forth in this Privacy Policy. You will be notified via email and/or a notice on our site of any change in the legal owner or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

Information Disclosed for Our Protection and the Protection of Others: In certain situations, we may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request (ii) enforce this Privacy Policy, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security, or technical issues; (iv) respond to user support requests; or (v) protect our rights, property, or safety. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention. We require all third parties to respect the security of your Personal Information and to treat it in accordance with applicable laws. We do not allow third-party service providers and Sub-Processors we share your Personal Information with, to use it for their own purposes and only permit them to process your Personal Information for specified purposes in accordance with our instructions.

Information Disclosed to our Personnel: In certain situations, we may be required to disclose Personal Information to those of our personnel who: (i) require access for us to fulfil our obligations under this Privacy Policy and agreements executed with LeapOnboard and (ii) are under confidentiality obligations as required under applicable law.

Consent: We may share your information in any other circumstances where we have your consent.

9. Data retention

We will retain your Personal Information in compliance with applicable laws. In the event you wish to withdraw your consent with respect to any Personal Information, please contact us in accordance with Section 11 of this policy below.

10. How we protect your information

We have implemented reasonable security safeguards in accordance with applicable laws, to safeguard and help prevent unauthorized access to your Personal Information and to maintain data security. However, we assume no liability or responsibility for the disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control.

You play an important role in keeping your personal information secure. You should not share your username, password, or other security information for your LeapOnboard account with anyone. If we receive instructions using your username and password, we will consider that you have authorized the instructions.

We shall act in accordance with applicable laws to notify you if any Personal Information is lost, stolen, or where there has been any unauthorized access. Furthermore, we undertake to investigate and/or take urgent remedial / mitigation measures as required under applicable laws, to remedy any such security breach.

11. Your rights associated with your information and grievance redressal

If you want to correct, complete, update or erase the Personal Information that we hold about you or if you wish to obtain details of the Personal Information, please write to us at [email protected]. Additionally, if you have any queries or concerns in relation to the Privacy Policy or if you have any grievances arising out of or in connection with this Privacy Policy, please write to us at the abovementioned email address.

When you submit a request, query and/or grievance, we will verify your request and identity, and we reserve the right to take additional steps necessary for verification. For example, we may seek to establish your identity by requesting additional information from you that we can match with information that we have in our records. We shall take our best efforts to respond to and adequately address all your requests, queries and/or grievances at the earliest.

While handling any such requests, queries and/or grievances, we shall be guided by applicable laws. Further, given the nature of the Platform, we may share your Personal Information with Clients and other third parties. You may need to make requests to such third parties per their respective privacy policy if you require them to update the records that they hold about you.

12. Changes to the privacy policy

We may amend or update this Privacy Policy from time to time, at our sole discretion. The most current version of this Privacy Policy will always be posted on our website. We encourage you to periodically review our website for the latest information on its privacy practices.

We will endeavour to provide notice of material changes to this policy on the homepage of the website and/or via email. Such material changes will take effect immediately after such notice was provided on our website and/or sent by email. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Platform will constitute your active acceptance of, and agreement to be bound by, the changes to the Privacy Policy.
